Cyberspace & Cyberlaw discusses the regulation of information and communication technologies (ICTs). In our modern societies the use of ICTs has become commonplace. Tools such as Facebook, Google Maps, the Oyster Card and electronic patient files have made our lives more efficient, easier and more fun. But they also raise all sorts of fundamental questions. Is the privacy of users protected? In which ways do these technologies affect users’ behaviours? And what are their effects on fundamental rights and civil liberties?

Goal of the course:
The speed with which new ICT services and applications are developed and marketed demands a high level of flexibility on the part of policy makers and lawyers. The goal of this course is to provide students with a critical and multidisciplinary perspective on the role and content of regulation in relation to new technologies, with a special focus on the Internet.
Eindkwalificaties (eindtermen van het vak)
After completing this course students will have acquired the following expertise:
1. An understanding of key points of the debate on regulating the Internet, and whether or not this is possible in the first place, as a consequence of the technical architecture of the Internet.
2. An understanding of some of the key domains in which regulatory debates have emerged in the last decades on the Internet, viz. privacy and security, freedom of expression, personalisation and profiling, and techno-regulation.
3. An understanding of the various parties that are involved in shaping regulation on the Internet, and their political, ideological and economical reasons for being involved.
Using this knowledge, students will be able to frame developments of new ICT services services and applications in various regulatory perspectives, and they will be able to critically evaluate the merits and downsides that these frameworks have.
The course will be supplemented with examples of actual debates on regulatory problems on the Internet, e.g. the debate over privacy on Facebook and that on the Pirate Bay and filesharing.

The final grade consists of the following elements: the final paper (70%), the second assignment (10%) and the final assignment (20%). The first assignment is introductory.

Opmerkingen
Er wordt geen bijzondere voorkennis verwacht over computergebruik.
Voor niet-rechtenstudenten wordt – wanneer van toepassing – in de eerste week een extra bijeenkomst belegd waarin extra literatuur wordt besproken.
Het vak zal slechts doorgang vinden bij een minimum van 15 deelnemende studenten.
