This course is intended to provide students with a thorough knowledge of and deep insight into contract law problems and solutions in an international perspective. This course consists of two parts.
The first part is dedicated to the general rules of contract law. In this part the major subjects covered will be the formation of the contract, defects of consent, interpretation and contents of the contract, performance and non-performance and remedies due to non-performance.
The second part is dedicated to Specific Contract Law. In this part rules concerning a number of important specific contracts will be analysed, namely sales contracts, labour contracts, contracts of works/procurement contracts, transportation contracts and franchise contracts. During the course attention will be paid to civil law systems, common law systems, as well as to transnational ‘principles’ like the PICC and the DCFR.

COURSE LEARNING OBJECTIVES

This course is intended to provide students with a thorough knowledge of and deep insight into contract law problems and solutions in an international perspective:
1. Content: The student can adequately reproduce, explain, and reflect on the core principles of the various topics covered in the International Contract Law course and keep up this knowledge through independent research.
2. Research abilities and ICT Skills: The student can critically engage with the materials provided and conduct independent legal research on a given topic covered within the course.
3. Working environment: The student can present his or her legal findings to the other students, can respond to questions about this topic, and can engage in a meaningful discussion about this topic.
4. Presentation of knowledge: The student can present knowledge acquired through independent research or course learning both orally and in writing in an accessible, well-structured and convincing manner.
5. Application of knowledge: The student can apply principles of international contract law to cases that do not appear in the materials.

METHOD OF INSTRUCTION

Seminars, group discussions, supervised writing and participating in a moot court.

EXAMINATION

Students will be assessed on the basis of their performance in the Moot Court (25% of final mark) and a written exam at the end of the course on any or all of the topics in the course (75% of final mark).

COURSE REQUIREMENTS

Full degree in law granting access to the legal profession (or equivalent).
