The Internal Market and Harmonisation


This course is intended to give the students a thorough grounding in the substantive economic law of the European Community as relevant for international business. The main focus is on the substantive provisions in the EC Treaty on the internal market, i.e. on the ‘four freedoms’ (free movement of goods, persons, services and capital) as well as on their link to competition law. A second part of the course deals with the harmonisation on the EC level of nationals law. This part considers the theory of harmonisation as well as the relationship of EC Treaty law and harmonising secondary law of the EC. Four important policy areas of the EC are considered in this context, namely agricultural law, transport law, tax law and social law. Like in the course in The Foundations of the European Union, one of the main aims of the course is to thoroughly familiarize the students with the primary materials of European Union Law (texts of legislation and case law), in order to prepare for the specialised courses of the second semester.

Methods of Instruction

Linked to this course is the (second part of) the European Law Moot Court competition in which students simulate an EU Law case by giving oral presentations at regional competition rounds and at the final round at the Court of Justice in Luxembourg, if the students advance to these levels of the competition.
