The course deals both with the substantive harmonization of national laws in the area of intellectual property and with the relationship between intellectual property rights and primary (Treaty) law on free movement of goods (Arts. 28 and 30 EC). The course devotes specific attention to the existing unitary Community concepts (i.e., the Community Trade Mark, and the Community Design), in the light of relevant case law. Developments at the European level are addressed against the background of the obligations flowing from the WTO’s TRIPs Agreement, to which both the European Community and the EU Member States are parties.

This course is held in conjunction with the Trademark Law Institute. In addition to the students of the Advanced Master course, this course is also open to a maximum of 10 selected IP students from universities all over The Netherlands.
