Description
The course provides an overview of the different areas of EU migration law by focusing on voluntary and forced migration.
The course begins with an introduction to the law and case-law concerning the free movement rights of EU citizens and the members of their family, and subsequently addresses the legal position of third-country nationals in the EU. It examines, amongst other topics, the concept of long-term residence, the right to family reunification, and the EU Blue Card Directive. Moreover, it discusses the Common European Asylum System, the 2020 Pact on Migration and Asylum, and the activation of Directive 2001/55/EC on minimum standards for giving temporary protection in the event of a mass influx. Finally the course focuses on global warming and migration.
The cross-cutting topic of human rights law is indispensable for a good understanding of EU migration law, which is why the course entails an introduction to human rights law.
Course objectives
Having successfully completed the course, course participants will be familiar with the main debates, case-law and legal questions that arise in the context of European migration law. In terms of skills, course participants will be able to find sources (judgments, secondary legislation) and to identify the important elements of these sources. The Moot Court cases furthermore enable course participants to apply their academic skills, when drafting the written submission to the court, and to enhance their presentation and pleading skills.

Assessment
The final mark will be a combination of the following marks obtained during the classes, weighted in the following way: The final mark will be based on a legal presentation for a moot court case (50 %), and a final exam (50 %). Students who do not achieve a passing mark as the final mark will be given the opportunity to take a retake exam, which will count 100%.
Weighing
The final mark for the course is established by determining the weighted average.
Resit
Any student who has not passed the course is eligible for the resit.
Exam review
How and when an exam review will take place will be disclosed together with the publication of the exam results at the latest. If a student requests a review within 30 days after publication of the exam results, an exam review will have to be organized.
