Description

In this course the most important intellectual property rights will be discussed, such as patent law, copyright law, trademark law and design law. These rights will be dealt with, both on the European and global scale. This means that we will study not only EC Directives and Regulations, but also global treaties and regulations such as the Paris Convention for the protection of industrial property and the TRIPS Agreement of the WTO.

Course objectives

Objectives of the course
1. You know which are the most important (international) regulations regarding intellectual property law, how they are related to each other and where these regulations can be found
2. You are able to make a distinction between the respective intellectual property rights, not only as regards the conditions for protection but also as regards the scope of protection, and you know the most important similarities and differences between those rights
3. You are able to analyse the legislation, case law and literature in the field of international intellectual property and to analyse and solve cases in this field

Achievement levels
1. At the end of this course you have learned which are the most important (international) regulations regarding intellectual property law and how they are related to each other. You also know where to find these regulations. This knowledge enables you to deal with the course objectives mentioned below successfully.

  1. You are able to make a distinction between the respective intellectual property rights, not only as regards the conditions for protection but also as regards the scope of protection, and you can describe the most important similarities and differences between those rights. As a result you are also able to analyse whether or not a specific intellectual property right can be used in a particular situation and whether or not in that situation also other intellectual property rights can be used at the same time.

  2. You are able to analyse the legislation, case law and literature in the field of international intellectual property law and to analyse and solve rather complicated cases, taken from everyday practice. It also means that you are able to read and understand national and international handbooks and scientific articles, government reports etc. with regard to this field of law.

  3. You are able to write a well-documented and well-argumented paper on a topic of intellectual property law, alone or in cooperation with other students.

Areas to be tested within the exam
The examination syllabus consists of the required reading (literature) for the course, the course information guide and the subjects taught in the lectures, the seminars and all other instructions which are part of the course.

Assessment method

Examination form(s)
1. Relating to achievement levels 3 and 4: Paper to be written in a team of students during the course (counting for 20 per cent of the final result)
2. Relating to achievement levels 1-3: Written examination at the end of the course (counting for 80 per cent of the final result).

  • The written assignment (paper) cannot be retaken. The 20% score earned on the written assignments will remain valid for the retake of the exam.

  • The final grade is given if the student has achieved a score on both parts (i.e. written assignment, and the written exam or retake).

  • If a student has not passed the course by the end of the academic year, the partial grades for the written assignment, and the written exam or retake are no longer valid.
