International Tort Law

2016-2017

The objective of International Tort Law is to give students a thorough understanding of the central themes of tort law from a comparative, transnational and international (global) perspective. Both the economic interests of the international businesses and the protection of actors of the international business activities will be subject to analysis.

In International Tort Law, the students will obtain knowledge of the various substantive tort law rules that apply to the business activities of their clients and the concrete conditions in which these clients develop these international businesses. The course aims to make the students familiar with a variety of tort law mechanisms that are (sometimes very) different in comparison with the tort law rules of their domestic civil law. During the course, both tort law theories (common law and statutory law) and tort law cases will be subject to analysis.

Weeks 1 till 4 deal with tort law, Week 5 deals with insurance issues.

The following main themes will be explored:
Week 1: Business Torts, Product Liability, Unfair Competition.
Week 2: Contract and Tort, Pure Economic Loss.
Week 3: Causation.
Week 4: Damage(s).
Week 5: Insurance issues.

METHOD OF INSTRUCTION
Once per week: lecture on specific tort law materials and cases
Once per week: Moot-court session (research, analysis, legal writing and advocacy through cases in relation to the themes examined in the preceding lecture).

EXAMINATION
Written exam
Moot-court: Evaluation of the written assignments and the oral presentations.

COURSE REQUIREMENTS
Full degree in law granting access to the legal profession (or equivalent).
